It is important for responsible parties in South Africa to work with (and not against) the Information Regulator. In an effort to facilitate this, we at Michalsons, have arranged a public webinar with the regulator. Join us to find out how and find answers to your questions. 

The regulator and Michalsons share a common goal of protecting people from harm and accountability through transparency. Michalsons specialises in providing our clients with legal know-how and support to comply with data protection and access to information laws. In South Africa, the regulator is responsible for enforcing the Protection of Personal Information Act (POPIA) and the Promotion of Access to Information Act (PAIA) by overseeing their implementation. 

In 2022, the regulator launched a platform on its website to enable people to lodge POPIA and PAIA complaints directly with the regulator if a responsible party infringes their privacy or denies them access to certain records. The regulator has also launched draft rules and regulations that are meant to inform how they enforce POPIA and PAIA and resolve complaints. 

Because the regulator is working hard to put measures in place to enforce POPIA and PAIA, there will always be events in your journey that will require you to engage with the regulator. For example, a change in the law, a court judgment, an enforcement notice, registering your officer, obtaining prior authorisation, or a data breach involving personal data.
