The information regulator has a dual mandate to enforce the Protection of Personal Information Act (POPIA) and the Promotion of Access to Information Act (PAIA). These Acts allow for the regulator to issue certain notices to help them monitor and enforce POPIA and PAIA effectively. You must know about the different types of notices that the information regulator can issue so that you can handle them correctly and timeously.
If you don’t deal with these notices correctly, you might risk getting a fine from the regulator. The regulator could also issue other penalties against you. If you infringe someone’s privacy or if you fail to give someone access to a record they requested without good reason, then POPIA and PAIA allow for people to lodge a complaint directly with the regulator. Thereafter you could receive one of the following notices from the regulator:
- An information notice,
- A pre-investigation notice,
- An enforcement notice, or
- An infringement notice.
