If you want to assure regulators, stakeholders, or customers that you comply with POPIA and PAIA, what better way than to prove that you comply with the Information Regulator’s own checklist (46 for POPIA and 23 for PAIA)? If you have a breach or if someone complains to the regulator about you, the regulator will check its portal. If you have completed the self-assessment, the regulator will look favourably upon you.

We have developed a process to assess compliance by conducting a gap analysis (at a point in time) against a POPIA and PAIA compliance framework, based on the Information Regulator’s requirements, to determine your organisation’s current level of compliance. We refer to it as a regulator-ready gap analysis. After the gap analysis, you can complete the self-assessment in the portal and be regulator ready.

Some people call this a compliance or risk assessment, or audit, but we believe the term gap analysis is correct. It is not a personal information impact assessment (PIIA), which is something different.

John Giles from Michalsons, who has extensive experience helping Information Officers fulfil their responsibilities. John is also the Information Officer for Michalsons and the authorised representative for many default Information Officers outside of South Africa. Michalsons has provided training for Information Officers both publicly and privately. John was the host of Michalsons Live for Information Officers and has run many strategy sessions with the default Information Officers of organisations. 

John has also previously presented on this specific topic, including how to utilise Legal Tech for regulatory compliance gap analysis. He has led more projects to do a POPIA gap analysis.
