| FreeThe new Consumer Protection Act opt-out regulations will have a significant impact on direct marketing. Who is a direct marketer? Well, just about anyone who communicates with people about goods or services. You are a direct marketer if you approach a person to promote goods or services (or ask for a donation). It includes all channels – in person, physical and electronic mail, SMS, chat and by phone.
The CPA opt-out regulations proposed by the DTIC will severely restrict your ability to direct market. Act now or prepare to comply at considerable effort and cost.
The Department of Trade, Industry, and Competition (DTIC) has proposed amendments to the Consumer Protection Act (CPA) regulations and has invited stakeholders to comment. These CPA ammendments regulate direct marketing by introducing a pre-emptive opt-out registry and imposing stricter requirements on direct marketers.
Some actions direct marketers will have to take in the future.
- Register annually with the DTIC and pay a fee.
- Check the National Opt-Out Register before sending any marketing communication.
- Be sure not to contact any consumer who has opted out.
These regulations, combined with trends under POPIA, could significantly impact direct marketing practices. You must act before the 12 December 2024 deadline to shape the outcome and influence the practical impact of the final regulations. There is no time to lose.
