Not the prevention-of-sales department
Too often, people see lawyers as the prevention-of-sales department. They see them as an obstacle to be overcome. Sadly, sometimes transactions are finalised despite the lawyers. Often, the parties to a contract are on really good terms and trust each other at the beginning of the process. But once the lawyers have been involved and drafted and negotiated the contract, the relationship between the parties has soured.
Too often lawyers see only the risks and not the opportunities. They see why something cannot be done – the obstacles. It is easy to say no.
- No, you can’t use that personal data to do that.
- No, you cannot use generative AI.
- No, don’t use electronic signatures to sign documents.
- No, don’t give that person access to that information.
- No, don’t move to the cloud. Cloud computing is too risky.
Rather say – yes, this is how we can do it in accordance with the law.
The rule of law is important
Organisations need to process data, use AI and keep information confidential. But it must be done in accordance with applicable laws and we must follow the rule of law. The rule of law is a foundational concept that helps maintain order, protect individual rights, and create a just and equitable society. It is crucial for the functioning of democratic governments, the protection of human rights, and the overall well-being of individuals and communities.
Everyone should be a champion of the rule of law. The alternative is chaos.
