The Regulator received a Code of Conduct (Code) from the Banking Association of South Africa (BASA). The Code deals with how the banking sector will process personal information. The BASA Code of Conduct aims to promote appropriate practices by BASA members who govern the processing of personal information in terms of the Protection of Personal Information Act (POPIA). Lastly, the Code establishes procedures for BASA members to interpret POPIA and other laws so that banks can swiftly resolve complaints. Affected parties have until 8 July 2022 to submit comments.
When will the code of conduct be finalised?
Once the regulator approves, the varied code of conduct will be published in the government gazette. Thereafter, BASA will publish it on its website within 14 days.
Governance of the Banking Association code of conduct
BASA will enforce the provisions of the code of conduct. The code of conduct will also ensure that:
- banks who are BASA members process personal information (including consumers’ information) in compliance with POPIA and the Banks Act 94 of 1990 and
- BASA members and third parties must conclude agreements with each other to process personal information in compliance with POPIA.
