Access to information (ATI) is a fundamental human right that promotes transparency and accountability. It enables us to make informed decisions, hold our governments accountable, and actively participate in shaping our world. As more organisations collect, monitor, and control data, the need for ATI increases.
The Information Regulator monitors and enforces compliance with the Promotion of Access to Information Act (PAIA). Part of the Regulator’s enforcement responsibilities include resolving PAIA complaints. This means that individuals who are refused access to a body’s records can lodge a formal complaint with the Information Regulator. Now that the Regulator has launched its complaints portal, anyone can lodge PAIA complaints effortlessly.
Public and private bodies must know how to respond to a PAIA complaint correctly and timeously so that they can resolve it. There are severe consequences for bodies that don’t respond to PAIA complaints appropriately. For example, you can get an enforcement or information notice from the Regulator, if you don’t respond to a PAIA complaint appropriately.
