When dealing with cybercrimes, we simply cannot ignore the procedural aspects of it, particularly at the investigation stage. Organisations want to ensure that any evidence like their documents, data, hardware or systems are properly managed and handled in all aspects of an investigation. With this in mind, the Cybercrimes Act required SAPS to put Standard Operating Procedures (SOPs) in place. These SOPs outline the procedures for investigating, searching, accessing, or seizing articles by SAPS and other investigators regarding cybercrimes. The SOPs are intended to ensure compliance with the legal requirements in the Cybercrimes Act. They aim to be a comprehensive framework to guide SAPS personnel and other investigators in effectively and lawfully carrying out their duties in combating cybercrimes. Still organisations need to understand how these procedures are implemented and the practicalities on how the SOPs will affect them.
