All organisations transfer personal data from one country to another, even if they’re unaware. Many of the services you use are accessible from different countries worldwide. For example, your cloud hosting service provider might host their cloud in Kenya, but you access it locally from South Africa. This is considered a transfer. Other typical transfers include sending your employee data to another country and storing it there.
When transferring data, you need to ensure that you:
- can transfer personal data, and
- do so lawfully.
You need to do a Transfer Impact Assessment (TIA) to do this. The objective is to check if your transfer is lawful and that the personal data is adequately protected once it leaves your country. Essentially, you should do a TIA to assess the impact on personal data (or privacy) if you transfer it to another country, and determine if you have put sufficient protection measures in place.
This webinar will help you understand the practical considerations when doing transfer impact assessments.
